From the supplier: Courts have shown reluctance in adjudicating toxic exposure-related claims for medical monitoring on a class action basis. Medical monitoring claims contain many individual issues that cannot be fairly decided class-wide. Plaintiffs must show proof of exposure, causation, risk of disease, and the necessity of medical monitoring to recover damages. Defense counsel should demonstrate how individual issues predominate the claims so that economy would not be achieved by a class-action suit.
